The identification and location of jurisdictional Waters of the United States (which includes wetlands) regulated by the U.S. Army Corps of Engineers (COE) under Section 404 of the Clean Water Act is determined through a process know as a jurisdictional determination (JD).  The JD process establishes if an activity is regulated by the COE or is not regulated by the COE.
